Acceptance of terms

By creating an Away Message account, you agree to these Terms of Service. If you do not agree, please do not use Away Message.

What Away Message is

Away Message is a digital legacy platform that allows you to record voice messages, videos, photos, and letters to be delivered to people you designate after your passing. Away Message is not a legal document service. Messages recorded through Away Message are personal and sentimental in nature and are not legally binding.

Your account

You are responsible for maintaining the security of your account. You must provide accurate information when creating your account. You may not share your account with others or use Away Message for any unlawful purpose.

Your content

You own the messages and content you record and upload to Away Message. By using Away Message, you grant us a limited license to store and deliver your content as directed by you. We will never use your messages for any purpose other than storing and delivering them to your recipients.

Delivery

Away Message uses a multi-Sender confirmation system to verify delivery. We cannot guarantee delivery in all circumstances. For example, if recipient contact information changes or if recipients cannot be reached, delivery may not succeed. We are not responsible for the emotional impact of message delivery on recipients.

Message Delivery and Sender Responsibility

Away Message requires confirmation from two independent Senders before any messages are delivered. This two-Sender requirement is a safeguard, but not an absolute guarantee against premature or erroneous delivery.

By accepting a Sender role, you affirm that you will only confirm a passing when you have verified, to the best of your knowledge, that the account holder has passed. Knowingly submitting a false confirmation is a misrepresentation and may result in legal liability.

Away Message is not liable for damages, emotional, financial, or otherwise, resulting from premature delivery, delayed delivery, or failed delivery caused by Sender error, inaccurate information, technical failure, or circumstances beyond our control.

The account holder is solely responsible for selecting trustworthy Senders and keeping all contact information current. Away Message does not independently verify the identity of Senders or the accuracy of passing confirmations.

Recipients and Senders agree not to hold Away Message liable for the emotional impact of receiving or delivering messages, regardless of the circumstances of delivery.

Prohibited uses

You may not use Away Message to:

• Record or store content that is illegal, threatening, or harassing
• Impersonate another person
• Store content that infringes on intellectual property rights
• Attempt to access another user's account or data

Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time from your profile settings.

Disclaimers

Away Message is provided as-is. While we take every precaution to protect your data and ensure delivery, we cannot guarantee uninterrupted service or perfect delivery in all circumstances.

Governing law

These terms are governed by the laws of the State of Georgia, United States.
